Meaning
Statutory provisions in Chinese civil law govern the application for interim property or evidence preservation during an arbitration proceeding. These measures allow a party to prevent a counterparty from disposing of disputed assets or destroying technical documentation before the tribunal issues a final ruling. Under PRC arbitration law article 28, the claimant must submit their application to the arbitration commission, which then forwards the request to the appropriate intermediate people’s court for enforcement.
Procedural Route
Legal action requires a strict sequence of administrative handovers to be valid. The claimant cannot apply to the court directly, but must use the arbitration commission as an intermediary. Once the commission receives the application, it must transmit the papers to the court within a set time frame.
This court has the sole authority to execute the freeze or seizure. This division of labor maintains judicial oversight.
Financial Security
Courts usually require the applicant to provide a counter-security deposit or a bank guarantee. This fund protects the respondent against losses if the claim is later rejected.
Remedial Limitation
The court must lift the preservation measures if the claimant fails to initiate arbitration within the statutory period. This timeline protects the respondent.
