Legal rights established by legislation allow contractors, suppliers, or manufacturers to retain possession of a customer’s physical property until outstanding invoices are settled. If a buyer defaults on payments for custom-molded parts, a statutory retention lien permits the mold maker to keep the physical injection mold in their possession. This legal mechanism provides a powerful incentive for the buyer to resolve the debt.
Legal Enforcement
Possessory rights must be exercised continuously, as voluntary surrender of the asset typically dissolves the protection. When a manufacturer asserts a statutory retention lien, they must notify the owner in writing, stating the exact amount of the unpaid debt and the deadline for payment. If the deadline passes without payment, the lienholder can petition the court to sell the asset to recover the outstanding balance.
This legal sale must follow strict rules to ensure the asset is sold for a fair market price.
Priority Claim
Claims of this nature often take precedence over other security interests in the same asset. A statutory retention lien will generally take priority over a bank’s prior security interest in the manufacturer’s tooling, provided the lienholder has maintained continuous possession. This prioritizes the actual service provider over general creditors.
Financial Settlement
Resolution of the payment dispute allows for the release of the asset. Once the outstanding invoice is paid in full, the statutory retention lien is lifted, and the mold must be returned to the buyer. This completes the contract.
