Meaning
Standard priority rankings determine the legal standing of a possessory lien over a perfected security interest according to this commercial code provision. If a repair shop holds a piece of testing equipment for an unpaid bill, us ucc 9-333 ensures they are paid before the bank that has a loan on the machine. This rule supports the people who provide services and materials for the maintenance of goods.
Priority Rank
Preference is given to the lien holder regardless of when the other security interests were filed. This is an exception to the normal first-in-time rule found in commercial law. It recognizes the value added by the person currently in possession of the item.
Lien Type
Protection only applies to liens that arise from the provision of services or materials in the ordinary course of business. A voluntary lien created by a contract does not get this same automatic priority under us ucc 9-333. The law focuses on protecting workers and suppliers.
Statutory Conflict
Resolution of competing claims is simplified by this clear hierarchy. Even if a lender has a global security interest in all company assets, the specific item held by a repairer is carved out. This clarity prevents long legal battles over the proceeds of a sale.
