It does not apply to equipment with an equivalent isotropically radiated power of less than 10 milliwatts.
Detection Threshold
Engineers set a specific power level that the radio must monitor before initiating a transmission. If the energy in the channel exceeds this detection threshold, the equipment must defer its data packet to avoid a collision. This mechanism prevents the degradation of nearby wi-fi and bluetooth connections.

The device must cease transmission within a few milliseconds of detecting an occupant in the operating channel.
